As the number of employees back at the office grows, so does the temptation to relax on Covid-19 health and safety protocols. But a senior legal advisor warns that employers can discipline employees who flout Covid-19 regulations outside of work, which could even result in dismissals – if they have certain policies in place. Justin Hattingh, a senior legal advisor at Strata-g Labour Solutions, explains that while employers are obligated under the Occupational Health and Safety (OSH) Act to provide a safe and healthy working environment, staff members must also comply to those regulations and ensure that they assist the employer in keeping everyone at the workplace safe and healthy.

Not wearing a mask or lying about your Covid-19 status can land you in hot water with your employer.

Employers can take disciplinary action or dismiss employees who flout Covid-19 regulations outside of work, an expert says.

Justin Hattingh, a senior legal advisor at Strata-g Labour Solutions, says that if an employer can prove an employee has behaved recklessly and that the person’s behaviour has endangered co-workers, it can take disciplinary action.

It’s time to think about having more employees that manage their function as if it were a business.

According the Quarterly Labour Force Survey (QLFS) released by Statistics South Africa (Stats SA), South Africa’s unemployment rate increased by 0.1 of a percentage point to 29.1 percent in the third quarter of 2019, making this the highest unemployment rate since Stats SA started measuring unemployment using the QLFS in 2008. The unemployment rate remained unchanged in the fourth quarter but, with further retrenchments by large blue-chip companies and parastatals in progress, corporate South Africa has no choice but to take a long, hard look at whether their approach to transformation and their efforts are enough to claw the South African economy out of the gutter are working.

This is because of the risk of causing severe illness or death to colleagues, or reputational damage to the company that employs you.

CAPE TOWN – Labour expert, Advocate Tertius Wessels from Strata-g Labour Solutions has warned that more retrenchments are on the table for South Africa’s workforce.

This comes amid news that South Africa’s unemployment rate increased to 27.6 percent in the first quarter of 2019.

“Major industries such as construction; mining and the banking sector have had to cut a total of 5 200 jobs due to various operational requirements and the stagnation of the economy,” said Wessels.

Legal director of Strata-g Labour Solutions, Advocate Tertius Wessels has cautioned that despite the Constitutional Court ruling on Temporary Employment Services (TES) of placed workers being deemed employees of the client, employees should not have an automatic expectation of being transferred onto the books of the client.

they need to be able to prove that they are up to the task in the same way that permanent staff are“If employees of the TES want to be treated no less favourably than an employee of the client performing the same or similar work, they need to be able to prove that they are up to the task in the same way that permanent staff are. Where there are no comparators employed by the client, employees under the employ of TES cannot succeed in their claim,” Wessels explains.
